Legal Dealings

related to operating the Sun Shack

In this section you will find information about the legal dealings I have been involved in while operating the Sun Shack website. Much of it is fairly boring but it goes to show that even a simple small public-domain website like mine can be subjected to the weight of large corporate legal machinery. 8-)

September, 2002 to Ongoing- Sun Microsystems (US - not Australia) Threatens Legal Action over Placing Field Engineer + System Handbooks Online

This is an item which originally reared it's ugly head in September 2002 originally, then re-surfaced again in February 2003.

Friday, September 6th, 2002 MCR - Sun Microsystems Initial Contact!

On 06-Sep-2002 I received an email message from Yolanda Harris at Sun asking about why I was publicly archiving the Sun Field Engineer and System Handbooks on this site.

I did write a reply but unfortunately it was lost during some system upgrades which took place during the ensuing months.

Tuesday, February 4th, 2003 MCR - Sun Microsystems Second Contact!

On 04-Feb-2003 I received another email message from Elaine Lee at Sun asking about why I was publicly archiving the Sun Field Engineer and System Handbooks on this site.

I wrote back with a short reply two days later (February 6th, 2003) which basically confirmed I'd received her email and pointed to my SRK legal jumble page so she could read about previous legal dealings I'd had with Sun.

Wednesday, February 19th, 2003 MCR - Second Email Received from Elaine Lee

Because I didn't directly address the issues Elaine had raised in the first email, she sent another email message on February 19th, 2003 requesting a prompt response about the issues being raised in the initial email.

Unfortunately I don't have a saved copy of my reply, but if I do locate it, the email will be placed online.

Friday, June 13th, 2003 MCR - Letter Received from Baker and McKenzie Solicitors

Surprise surprise! Right out of the blue on 13-Jun-2003 I received a Registered Post notification card in the mail box (my wife and I were out at the time - taking our new baby boy to a doctor's appointment). After collecting the item at the post office, it turned out to be a letter from Baker and McKenzie Solicitors (which was also Cc:d by email).

The letter was dated the previous day (ie. 12-June-2003), and it contained a list of demands with a compliance cut-off date of 26-Jun-2003.

May 2006 Update - Sun's Decided That They have Bigger Fish to Fry! lol

Since the flurry of activity in 2003, everything has gone quiet. Sun doesn't harass me any more about my selling activities, nor about the Sun Field Engineer and System Handbooks being online. I have noticed that the SunSolve website has totally changed and access to much of the more important info from the System Handbooks is restricted to people with service contracts only. That's a pity, but not unexpected.
